    Visa Dispute Between Turkey and EU Further Colors Relations

    ap Turkey+chief+EU+negotiator+Egemen+Bagis+21dec09 eng 300A new dispute between Turkey and the European Union is threatening to further undermine Ankara’s remaining faith in its membership bid.  The dispute centers on Brussels easing visa controls on Balkan countries, but continuing its controls on Turkish visas.

    Observers say a decision by the European Union to lift most travel restrictions on Balkan countries has annoyed many Turks.

    None more so than those who have to regularly apply for visas to travel to the European Union for business, like Sibel Aktas, who spoke while waiting outside the Italian consulate for a travel visa.

    “Of course it is bad, we are gathering a lot of papers and together with these papers we are going to a lot of places,” she said.  “So, it takes a lot of time and we spend money for some of the papers.  I hope we get rid of this process.”

    The EU refusal to ease visa requirements for Turkey, even though the country is applying for full membership in the bloc, has become a focal point of growing anger in Ankara. Turkey’s Minister for EU Affairs, Egemen Bagis, is crying foul.

    “Well this is just another double standard that we are complaining about in the European Union,” he said. “There are fears in Turkey against the European Union and fears against Turkey in the EU. And the real underlining reason for the fears?  We do not know one another enough.  People usually fear countries they do not know enough about.  Once you get to know them, you find out there strengths and weaknesses, then you realize there is nothing to be afraid of.”

    But Turkish analysts say arguments like these are making little headway in Brussels.

    According to the co-leader of the European Green Party, Daniel Cohn Bendit, even though the European Union allows visa-free travel with poor countries like Albania, it is not a case of double standards, it is a case of relative size.

    “Albania is not a problem, Turkey is a big country.  This is a debate I have had with the Turks,” he said. “Free travel between Turkey and Europe is an immense opening, there are fears, there are problems, the Germans for the working market is a problem.  So we have to push in this direction you know.”

    But frustrations are growing, especially as Turkish businessmen and truck drivers have won a series of cases in the European Court of Human Rights, which ruled a customs treaty Turkey signed with the European Union entitled Turkish businessmen to the right to visa-free travel.

    Cohn Bendit says the European Union needs cooperation from Ankara if it is to stem illegal immigration. Turkey is a main transit country into the European Union for illegal migrants coming from Asia minor and Africa.

    Brussels is pressing Ankara to allow illegal migrants that enter the European Union through its territory to be sent back to Turkey.  Cohn Bendit says this Readmission Treaty is being billed as the price for Brussels easing restrictions.

    “Turkey will sign a readmission program and Europe will ease the visa question,” he said.

    Cohn Bendit says a deal is expected to be reached early next year, but analysts say such horse trading will do little to ease feelings in Ankara that there is little goodwill left toward Turkey in Brussels.

    Flags Turkey Azerbaijan 140910An agreement on the bilateral abolition of the visa regime is expected to be signed between Turkey and Azerbaijan in January 2011, the Turkish Aksam newspaper reported today.

    About 20 agreements are expected to be signed by the foreign, interior, commerce, industry, transport, environment, health and defense ministers of the two countries.

    Earlier, Azerbaijani Foreign Minister Elmar Mammadyarov said work to abolish the visa regime between Azerbaijan and Turkey is underway. He said “some bureaucratic problems” were preventing the process from developing more quickly. After their elimination, the agreement will be signed, he said.

    In addition, according to the newspaper, a meeting between the ministers of the two countries with the participation of Azerbaijani President Ilham Aliyev and Prime Minister Recep Tayyip Erdogan is also expected to be held in March 2011.

    After a meeting between Aliyev and Erdogan in Istanbul in September, a joint declaration on the establishment of a council on strategic cooperation was signed between Azerbaijan and Turkey.

    Turkey and Poland have the potential to be the tigers of the global economy, according to Polish Prime Minister Donald Tusk, who gave a speech at the Turkey-Poland Business Forum in Istanbul on Thursday.

    The Polish prime minister said: “However the EU’s attitude is, in Poland’s foreign strategy, Turkey’s entrance to the EU was a fixed item.” He added that he was not saying this just out of courtesy, but because they thought Turkey’s participation in the union would be for the best interest of all the members. He also said he hoped during Poland’s presidency term in the future the negotiations for membership would accelerate.

    The business forum was organized by the Foreign Economic Relations Board, or DEİK.

    Tusk said the friendship between the two countries had deep roots and sound foundations, calling it an exemplary case in terms of international affairs.

    He said a great many giant economies’ prestige had been severely wounded during the economic recession, whereas Turkey and Poland both came out fo the period clean, which he found particularly noteworthy.

    Tusk said Poland was set to continue its growth trend and is planning significant investment expenditures in the coming term.

    “The investment opportunities in Poland will definitely attract entrepreneurs,” he said.

    Tusk concluded his speech by mentioning the Turkey-EU visa issue. He promised that Poland would do all they could to remove visa obstacle and would put pressure on the EU about this. He said Poland had already agreed with the idea that the union should ease the visa regime with its neighbors and was a leading figure in working to make that happen.

    The Istanbul Chamber of Commerce and the Italian Consulate General in Istanbul have signed an agreement to provide Turkish businessmen with visa facilities.

    The Istanbul Chamber of Commerce and the Italian Consulate General in Istanbul have signed an agreement to provide Turkish businessmen with visa facilities.

    Under the agreement, Turkish businessmen will be able to get a five-year Schengen visa after applying to the Italian Consulate General with a recognition letter from the Istanbul Chamber of Commerce. The Schengen visa will also enable Turkish businessmen to travel to the other European countries.

    Meanwhile, Istanbul Chamber of Commerce Executive Board President Murat Yalcintas was awarded by the Italian president with Italy’s state medal of merit for his contributions to efforts to further improve Turkey-Italy relations. Italian Ambassador to Turkey Carlo Marsili decorated Yalcintas with the medal during the signing ceremony.

    The existence of an agreement called “The European Agreement on Regulations governing the Movement of Persons between Member States of the Council of Europe” which was opened for signature by Council of Europe member states on 13 December 1957 has been revealed. The aim of the Agreement is to enable the nationals of States Parties to enter or leave the territory of another Party by all frontiers on presentation of one of the documents listed in the appendix to the Agreement. The facilities accorded are only available for visits of not more than three months’ duration.
    However, this free movement of persons may be restricted by each State Party under certain circumstances. For example, The Benelux (Belgium, Luxembourg, The Netherlands), France, and Germany applied this restrictions effectively against Turkey during the early 1980s. This practice is still being maintained with a few exceptions.
    Spain and Italy are among those countries who have signed the Agreement. However, these two countries have never issued any official objection against the free entrance or leave of Turkish nationals. Spain and Italy have not officially informed the related authorities that they imposed restrictions for Turkish nationals. The same situation is also valid for Greece. Therefore, Turkish nationals are free to enter these three countries without any visa requirement. According to the Article 307 of the European Community Agreement, the European Community Law has the superiority even if any conflict arises in the implementation of the Schengen Agreements. Requiring visas from Turkish nationals in these countries means the violation of the Agreement signed in 1957.

    The lack of required domestic and international publicity by the Turkish diplomacy about the rights and responsibilities of Turkish nationals underlined in the Agreement is a puzzling situation.
