    Ethnic Kurd wins high court release ruling after failed deportation

    Home Office attempts to forcibly deport thousands of failed Iraqi asylum seekers suffered a setback today when it emerged that Baghdad has objected to any “increase in returns”.

    The official refusal surfaced in a high court test case , which ruled that an ethnic Kurd should be released after 21 months in immigration detention because there was no likelihood of his being sent back, even in the “medium term”.

    The decision by Mr Justice Langstaff may relate only to a single individual – Soran Ahmed, 22, from Kirkuk – but the judgment has exposed the Iraqi government’s reluctance to receive deportees and the difficulty UK officials have persuading counterparts in Baghdad to cooperate.

    An internal Whitehall document, read out to the court, detailed how the UK Border Agency is proposing to fly Iraqi officials into Britain so that they can understand and “buy-in” to the deportation process. It also suggested arranging a UK ministerial visit to Baghdad to stress “the importance of returns to Iraq“.

    Ahmed, whose case was supported by the Refugee and Migrant Justice (RMJ) civil rights group, was one of 44 failed Iraqi asylum seekers forcibly put on an abortive charter flight to Baghdad last October with private security guards; Ahmed claimed he was assaulted on board.

    In Baghdad, Iraqi interior officials never appeared and the deportees interviewed by an infuriated Iraqi colonel in charge of the airport. “He was antagonistic from the outset,” Mr Justice Langstaff commented.

    The colonel accepted 10 deportees and ordered the rest back to London. They did not have the correct Iraqi documentation, he claimed, or were ethnic Kurds who would be in danger in the predominantly Arab city of Baghdad.

    There are regular UK deportation flights to the relative peace of the Kurdistan Regional Government area in northern Iraq. Other European countries have been sending failed asylum seekers back to central and southern Iraq. The UK is meeting stiffer resistance to this route.

    The United Nations high commissioner for refugees (UNHCR) still opposes repatriations to the central five governorates of Iraq due to the risk of violence. An email from officials in Baghdad to Whitehall last May “disclosed a reluctance to see an increase in the return of Iraqi nationals from the UK to Iraq,” the judge said.

    A Foreign Office official who flew to Iraq several times to prepare the way for the flight explained that he met resistance from Iraqi officials to EU documentation. On receipt of the full list of deportees the Iraqis said: “We will see what we can do”.

    A report from the conference reviewing the failure of the October flight suggested that the UK Borders Agency should learn from more successful EU deportation programmes and the Iraqi prime minister’s office should be written to for help. The high court heard that the letter has still not been despatched.

    It would be unlawful to continue to detain Ahmed, said Langstaff. He was previously imprisoned in Britain for sexual assault and using false documents. There was no prospect of UK flights returning him to Kirkuk via Baghdad this year and the Kurdish Regional Government would not accept him. The judge ordered him to be released under strict bail conditions despite the fact that he posed “some risk” to the public. Bail conditions will be determined at later hearing.

    Caroline Slocock, chief executive of RMJ, welcomed the judgment. “”[The flight] should never have left the UK. Home Office staff widened their own criteria on who could safely be on board, largely to fill empty seats at the last moment.

    “Not only was the destination of the flight kept secret from those being removed, but it is now clear Iraqi authorities were kept in the dark. The alarming picture emerging is of Home Office officials out of control. Officials needs to get a grip of the problem rather than egg officials on by changes of policy which make it easier for the remove people without proper judicial scrutiny.”

    Armenia Showcases Iran Ties, as Talks With Azerbaijan and Turkey Falter

    Armenia is showcasing its close relationship with Iran at a delicate time in its negotiations with two other, less friendly neighbors: Azerbaijan and Turkey. With the normalization of Turkish-Armenian relations and the resolution of the Karabakh conflict looking increasingly problematic, authorities in Yerevan seem to be hedging their bets by pursuing more multi-million dollar commercial projects with Tehran.

    Armenian leaders have also made a point of underlining Iran’s broader geopolitical significance for their landlocked country and what they have long described as Tehran’s “balanced” position on the Karabakh dispute. Their Iranian counterparts have readily reciprocated that praise in the latest flurry of diplomatic activity between the two governments. “The foundation of the two countries’ relations is being fundamentally strengthened and cooperation in such major fields as energy, transportation, and communications would project a new image of our bilateral ties,” Iranian Foreign Minister Manouchehr Mottaki said at the end of a two-day visit to Yerevan on January 27 (IRNA, January 28).

    “You know well what importance we attach to relations with the Islamic Republic of Iran, and that we perceive you as a reliable partner and a country with a pivotal significance in the region,” Armenian President Serzh Sargsyan told Mottaki during their talks adding, “Therefore, the development and deepening of bilateral relations stems from our interests” (Statement by the Armenian presidential press service, January 27).

    The main official purpose of Mottaki’s trip was to co-chair with the Armenian Energy Minister Armen Movsisian a regular session of an Armenian-Iranian inter-governmental commission on economic cooperation. The meeting focused on plans for building a railway connecting the two countries, a pipeline to deliver Iranian oil products to Armenia, and a major hydro-electric station on the Arax River marking the Armenian-Iranian border. Mottaki and Movsisian said they have made further progress on these projects, requiring billions of dollars in funding, but announced no dates for their implementation. The Iranian minister said only that the commission is “aiming to achieve quick results” (Kapital, January 27).

    With an estimated cost of $2 billion, the railway project is particularly ambitious. Just how the two sides, and Armenia in particular, plan to finance it remains unclear. The Iranian government reportedly expressed its readiness during Sargsyan’s April 2009 visit to Tehran to provide a $400 million loan to Yerevan for that purpose. The Armenian side, which would foot the bulk of the bill due to the virtual absence of any rail infrastructure in its southeastern Syunik region bordering Iran, is expected to seek the remainder of the funding from multilateral lending institutions. One of them, the Manila-based Asian Development Bank, has already agreed to finance a $1 million feasibility study on the project to be conducted soon.

    Armenian-Iranian economic cooperation has, until now, centered on energy, resulting in the construction of a natural gas pipeline inaugurated by the two governments in December 2008. In May 2009, Armenia began importing modest amounts of Iranian gas (approximately 1 million cubic meters per day) and paying for it with electricity supplies to the Islamic Republic. The volume of those deliveries is due to rise sharply after the planned construction of a third high-voltage transmission line linking the Armenian and Iranian power grids. Movsisian said in November 2009 that the work on that line will start in 2010 and take about 18 months (www.armenialiberty.org, November 12). The ongoing reconstruction of Armenia’s two largest thermal-power plants, the main recipients of Iranian gas, should be completed by that time.

    Mottaki arrived in Yerevan less than a week after the former Armenian President Robert Kocharian’s surprise visit to Tehran, which sparked intense media speculation in Armenia. Kocharian held talks there with the Iranian President Mahmoud Ahmadinejad and Mottaki. The official Iranian IRNA news agency cited Ahmadinejad on January 21 as calling the Armenian-Iranian relationship “very friendly” and saying that the two neighboring nations are “determined to implement joint projects and play an active role in regional developments.” Both the Armenian government and Kocharian’s office insisted afterwards that the former president, who has kept a low profile since handing over power to Sargsyan in April 2008, visited Iran in a private capacity, even though he was invited by the Iranian government. Speaking at a news conference in Yerevan, Mottaki described Kocharian’s talks in Tehran as a conversation between old “friends” who share “good memories of the past” and have plans for the future (www.armenialiberty.org, January 27).

    Some Armenian media commentators construed Kocharian’s first major political engagement since his resignation as a sign of his impending bid to return to power. Others said, however, that Sargsyan himself sent his predecessor and longtime ally to the Iranian capital to warn the West against pressuring Armenia to make additional concessions to Azerbaijan and Turkey. The main opposition Armenian National Congress (HAK), Kocharian’s most bitter detractor, subscribed to the latter theory. In a January 26 interview with Radio Free Europe’s Armenian service, one of the HAK leaders, Levon Zurabian, speculated that a high-profile visit to Tehran by Sargsyan or another serving Armenian leader would have made Yerevan’s diplomatic gambit too galling for the United States and other foreign powers involved in the Karabakh peace process.

    According to the pro-government newspaper Hayots Ashkhar, Kocharian’s trip was meant to send a different message to the West. The paper said on January 26 that it reflected Yerevan’s frustration with the Western powers’ failure to convince Ankara to stop linking the normalization of Turkish-Armenian relations with a Karabakh settlement acceptable to Azerbaijan. The Armenian leadership, it said, “cannot sit and wait for the West to exert serious pressure on Turkey.”

    In what might be a related development, Iran’s Defense Minister Ahmad Vahidi has invited his Armenian counterpart, Seyran Ohanian, to visit the Islamic Republic in the coming months. Ohanian received the invitation at a February 3 meeting with the Iranian Ambassador to Armenia, Seyed Ali Saghaeyan. A statement by the Armenian defense ministry said they had discussed “regional problems of mutual interest and issues related to the resolution of conflicts.”

    Gates said, we have discussed the possibility of erecting two radars in Turkey.
    United States (U.S.) Secretary of Defense Robert Gates said Saturday his meeting with the Chief of Turkish General Staff, General Ilker Basbug, was almost completely devoted to the issues of Afghanistan and PKK.

    Speaking to a group of Turkish and U.S. journalists in Ankara, Secretary Gates said that they had “not requested any new troops from Turkey.”

    We are pleased with the partnership between Turkey and the U.S. in Afghanistan, Gates said.

    We “discussed, with General Basbug, Turkey’s role in the missile defense system and relations between our armies”, Gates noted.

    “PKK issue”

    We carry a will to further develop cooperation with Turkey against the terrorist organization PKK as was set forth by former U.S. President George W. Bush back in 2007, Gates stressed.

    We are searching for new opportunities that Turkey could utilize against the threat emanating from terrorist organization PKK, Gates said.

    The commander of U.S. forces in Iraq, General Ray Odierno, had arrived in Ankara to hold talks on this (PKK) issue, Gates emphasized.

    Cooperation between Turkey and the U.S., against PKK, is getting more intense, Gates said.

    In regard to his talks at the Turkish General Staff, Secretary Gates said that “as the General noted, the final solution does not involve killing all”.

    While speaking with the leader of the regional administration in north of Iraq, Massoud Barzani, I have stressed the importance of placing pressure on PKK to end violence, Gates said.

    “Missile defense system”

    The dialogue on what Turkey could do within NATO to counter the proliferation of ballistic missiles via a missile defense system continues. We have discussed the possibility of erecting two radars in Turkey, Gates said.

    Reminded by a journalist about comments made by Turkish Prime Minister Recep Tayyip Erdogan that there were actually countries in the region that possessed nuclear weapons, aside from Iran, like Israel, Secretary Gates argued, that Iran was “a country that openly announced a will to destroy another country” and violated the Treaty on the Non-Proliferation of Nuclear Weapons.

    We are “not against” Iran’s peaceful nuclear works. However, Iran continues efforts for uranium enrichment, Gates noted.

    I have not seen a progress with Iran on this matter. In order to be a progress, the Iranians must give up their enriched uranium to the International Atomic Energy Agency (IAEA), Secretary Gates said.

    Asked if Turkey is making sufficient efforts in regard to the issue of Iran, Gates said that Turkey was valuable as they could talk to the Iranians, a mission highly difficult for the U.S.

    There could be opportunities (from Turkey’s dialogue with Iran). We need to have a common understanding on concerns expressed, under the roof of the United Nations, pertaining to programs inititated by Iran, Gates stressed.

    I have observed such an understanding in Turkey. We will continue on this path, Gates underlined.

    Asked about what he thinks on comments made that Turkey has shifted its axis, Secretary Gates said that Turkey was in a unique position geographically and that their efforts in all fields must be received positively.

    We are extremely pleased with Turkey’s contributions in Afghanistan. We have received a promise from “allies and partners” for the deployment of 10,000 additional personnel. We pay high importance to personnel that can train individuals (Afghans) in the areas of military and security, Gates said.

    Iran says it enriches uranium for civilian applications and that as a signatory to the nuclear Non-Proliferation Treaty, it has a right to the technology already in the hands of many others.

    Israel, most experts estimate that it has at least between 100 and 200 nuclear warheads, often threatens Iran with an attack.

    THE VERY FIRST IN THE ISLAMIC WORLD: ADNAN OKTAR ESTABLISHES BROTHERHOOD BETWEEN JEWS AND MUSLIMS

    HahamlarThe meeting Mr. Adnan Oktar held with the committee from Israel was followed with great interest both by the Islamic world and the West, and accepted to be a great step towards the establishment of peace in Middle East.
    On January 20, 2010, Wednesday, Mr. Adnan Oktar held a press meeting with a broad committee from Israel including the leaders of various religious groups and Mr. Ayoob Kara, the Deputy Minister of the Development of the Negev and Galilee. The purpose of the press conference is declared to prevent the artificial tensions striven to be formed between Muslims and Jews, to ensure the establishment of peace in the region and make a call to the public for the release of Israeli Private Gilad Shalit, who has been held captive for a long time.

    Mr. Adnan Oktar delivered a speech in the meeting and stated that Muslims and Jews were the descendants of Prophet Abraham (pbuh)—one party being the descendant of the sons of Ishmael whereas the other being the descendant of the sons of Jacob—and thus the conflicts occurring between the two communities were quite unfounded. He further added that Jews and Christians were committed to their trust and, just like in the time of the Prophet Muhammad (may Allah bless him and grant him peace), he would ensure best protection for them, and let neither Jews, nor Christians and nor Muslims be subjected to the slightest harm, stressing that this was the kind of attitude in compliance with the Qur’an and the hadith. Mr. Oktar stressed that the century in which we lived was the “Age of Mahdism” and that from then on wars, bloodshed and terror would come to an end, all weapons would be left and love would reign all over the world, the Middle East being the foremost. In reply to the question about the Iran’s nuclear weapon production, Mr. Oktar said that according to the Qur’an, the use of atomic bomb was unlawful (haram) and he sent a message to the Iranian Prime Minister Mr. Mahmoud Ahmadinejad about this issue and, indeed no sooner Iran made a statement declaring that atomic bomb was unlawful and thus Iran would not use it. Mr. Oktar also added that Turkish daily Hurriyet carried this statement to the headline.

    Mr. Oktar, who also answered the questions about Private Gilad Shalit said, “It is very difficult for a person to be held captive under constant death threat.” Mr. Oktar also stated that Gilad wanted to rejoin his parents and that the pain suffered by both Gilad and his parents had to come to an end in no time. He also noted that the mothers, daughters and youth held in Israeli prisons had to also be released right away and added, “We desire each one of these brothers of ours come out of those prisons with the good morals of angels and become the kind of people who, by means of science and culture, struggle for peace.” Mr. Oktar noted that contacts with Noam Shalit, Gilad’s father, were continuing, that he would be coming to Turkey in the following days but the details of his itinerary were being withheld due to security concerns. Mr. Oktar stressed that the efforts of those who strove to form tension between Israel and Turkey were in vain and those who desired conflicts to occur between Jews and Muslims, Muslims and Christians, Shiites and Sunnis, Shiites and Wahabbites were people who were in favor of constant bloodshed but that they would not attain their goals.

    Rather than acting in a way that fans the flames, Mr. Oktar stressed the importance of assuming an appeasing, forgiving attitude that left the past behind but thought ahead and employed a peaceful and moderate style, and made important statements regarding how the outlook of Muslims and Jews had to be. He also stated that the words in the Qur’an, “Do not take Christians and Jews as patrons” was misinterpreted by some people, that the phrase “do not take as patrons” actually meant not making Christians and Jews “governors” for themselves and that that was quite natural since, for the general comfort of the public, the governor of a Muslim community would be a Muslim, the governor of a Christian community would be Christian and the governor of a Jewish community would be a Jew. Mr. Oktar reminded that the People of the Book lived at ease in our Prophet’s (may Allah bless him and grant him peace) time, that during the time of the Ottoman Empire, Jews were brought all the way from Spain, our lands were opened to them and they were placed and hosted there in the best way possible. Mr. Oktar added that just as it was the case in the past, people had to live in bliss.

    Other participants of the meeting drew attention to the importance of holding such a meeting for peace and brotherhood. Rabbi Yeshayahu Hollander, the Chairman of the Sanhedrin Court for B’nai Noah, read the message sent by Syrian mufti expressing his support for the initiation and stressed that the union of those who believe in only one Allah was a great power. Mr. Ayoob Kara, the Deputy Minister of the Development of the Negev and Galilee, said he believed this meeting would be instrumental in leading to a very noteworthy change in the Islamic world and expressed his happiness of being a part of this initiation. Hurrian Dimitri, the Orthodox Christian Leader, said the purpose of their existence in Istanbul and the message they would like to convey was the co-existence of all religions with love, brotherhood and peace and stated that, just like our Prophet (may Allah bless him and grant him peace), Mr. Adnan Oktar was a very great person who became instrumental in changing all violence and prejudices.

    The meeting was followed with great interest both by the local and foreign press. Mr. Oktar stated that the Prophet Jesus (pbuh) would appear very soon, no wars would any longer take place, and the world had entered an era in which science, arts and aesthetics would prosper and gave the glad tidings of the establishment of the Turkish-Islamic Union in the very near future. “Two years ago I told that visas would be removed and Turkish Islamic Union would be established and this is how the events proceed now”, said Adnan Oktar. He added that a great unity of love and friendship had started to unfold and this unity would be the guarantee of peace on Earth.

    How the Turks Saved the Jews from Genocide

    In the fall of 1921 a Turkish steam ship sailed into New York harbor named the SS Gul Djemal, the name of the ship meant “Beautiful Rose.” On that ship, was my great-grandmother Rosa and her brother Eli; their father Isaac had arrived sometime earlier, all were Spanish speakers, all set sail from Turkey.

    My family spoke the Spanish language because their ancestors had fled Spain in the late 15th century when the Spanish government committed one of the most heinous acts in history, the ethnic cleansing of the Jewish population of Spain through near-total displacement of its Jews. Although the Jews had existed in Spain prior to the invention of the Spanish language or even the arrival of Christianity, in 1492 they were subject to mass violations of human rights and were forced to flee–or as the Spanish government put it, they would “incur the penalty of death.”

    In the end, hundreds of thousands of Jews fled Spain, leaving behind what would amount in today’s monetary system as billions of dollars in assets. These assets included private property such as homes, furnishings, jewelry, books, family objects, clothing, etc; and communal property such as businesses, real estate, synagogues, etc.

    The only reason why I am able to sit here in 2007 and write this essay is because at the time when the Spanish government advised the Jews they would have to flee their homeland or face death, the Sultan of the Ottoman Empire–the leader of the state that existed before the modern Republic of Turkey–allowed my family and our people to seek refugee in his lands, this includes what is today Turkey, Greece, Lebanon, Syria, Egypt, Israel, the Balkans, and other places. Not only were the Jews allowed to go freely, but the Ottoman Empire sent ships to the west to assist the Spanish refugees in their terrible plight.

    Sultan Mehemet stated: “Who among you of all my people that is with me, may his God he with him, let him ascend to Constantinople, the site of my royal throne. Let him dwell in the best of the land, each beneath his vine and fig tree, with silver and with gold, with wealth and cattle. Let him dwell in the land, trade in it, and take possession of it.”

    When the most powerful nation in the world, 15th century Spain, openly and publicly threatened genocide against the Jewish people for the stated crime of practicing their own religion-Judaism, it was a Muslim government, the Ottoman Empire, which stepped in and saved the Jewish people from destruction. It was the Ottoman Empire that saved the Jews of Spain and to a great extent, Portugal, from certain death which the goverment threatened them with.

    Unlike the Christian kingdoms of Spain and Portugal, the Ottoman Empire never had a system of government-sponsored hatred against the Jewish people. Even though Jews were dhimmis, the government of the Ottoman Empire never set in place specific targeted anti-Jewish policies such as those that existed in Christian Europe. It is a sad reality that today many people only remember the Ottoman Turks for alleged bad treatment of minorities, when clearly, they have done many positive things that we today hundreds of years later should continue to praise.
