    JERUSALEM – After a six-month investigation, the U.N.’s Fact Finding Mission on the Gaza Conflict has concluded there’s evidence that Israeli forces and Palestinian militants committed war crimes during Israel’s recent military operations in Gaza .

    The mission, headed by South African jurist Richard Goldstone , called on the United Nations Security Council to monitor Israeli and Palestinian investigations into these charges and urged that if these aren’t taking place in good faith to refer these cases to the International Criminal Court in The Hague, Netherlands .

    The 554-page report released Tuesday has detailed investigations into 36 incidents, including some that McClatchy reported previously, such as the shooting of civilians with white flags, the firing of white phosphorus shells and charges that Israeli soldiers used Palestinian men as human shields.

    According to the report, these violations weren’t aberrations but rather appeared to be “the result of deliberate guidance issued to soldiers.”

    The commission charged Palestinian groups with indiscriminately firing at southern Israel and causing terror among the civilian population. The mission didn’t find evidence of Israeli charges that Palestinian militants deliberately hid among civilians. Israel has released a number of videos purporting to show Hamas militants using civilians for cover.

    The commission, charged with investigating allegations of war crimes related to Israel’s military operations in Gaza , began its work April 3 . The 22-day military operation, which began last Dec. 27 , cost the lives of more than 1,400 Palestinians and 13 Israelis.

    The four-person mission came under attack almost immediately from Israeli officials, who refused to cooperate. They charged the mission with being one-sided, pointing out that the original mandate authorized an investigation into charges of Israeli war crimes and was altered only by an agreement between Goldstone and the president of the U.N. Human Rights Council .

    Special criticism was reserved for commission member Christine Chinkin , a professor at the London School of Economics and Political Science , when it was discovered that she’d signed a letter last January published in The Sunday Times that accused Israel of war crimes.

    A constant theme of Israeli soldiers’ testimony after the war was that the Israel Defense Forces had made the protection of soldiers’ lives its top priority. The report criticizes this approach, saying, “They must avoid taking undue risks with their soldiers’ lives but neither can they transfer that risk to civilian men, women and children.”

    The mission didn’t confine itself to investigating the operation. The report also refers to Israel’s blockade of Gaza as a “collective punishment” and says “the series of acts that deprive Palestinians in the Gaza Strip of their means of subsistence, employment, housing … could lead a competent court to find the crime of persecution, a crime against humanity, has been committed.”

    Mark Regev , a spokesman for the Israeli prime minister’s office, reacted harshly to the report: “It was born in sin. Countries with atrocious human rights records sit there and criticize Israel . It’s not just Israel that criticized the Human Rights Council . Kofi Annan and Ban Ki-Moon have criticized its obsession with Israel ,” referring to the former and current U.N. secretaries general.

    Israeli human rights groups have issued a statement calling on the government to “conduct an independent and impartial investigation into the suspicions.”

    Avi Bell , a professor of Law at Bar Ilan University , took exception to the report, disagreeing with its legal conclusions and pointing out, “They say they are a fact-finding mission. So how are they coming up with all these legal conclusions, especially wrong ones?”

    The report is due to be presented to the U.N. Human Rights Council on Sept. 29 and the council will then decide whether to refer it to the Security Council . If it’s referred to the Security Council , that council will decide whether to adopt the recommendations.

    According to Bell, if charges are referred to the International Criminal Court, the court will have no jurisdiction, since Israel isn’t a party to the court. “In order for the International Criminal Court to have jurisdiction, the accused has to be a citizen of a state that accepts the court’s jurisdiction,” he said.

    Turkey, Jordan warn Israel on Jerusalem settlements

    ANKARA — Turkey and Jordan warned Israel Wednesday that settlements in east Jerusalem threatened peace efforts, amid press reports that the Jewish state is to revive construction plans in the annexed region.

    “Israel needs to act with responsibility on the issue of settlers and especially developments in east Jerusalem,” Turkish Foreign Minister Ahmet Davutoglu told a news conference with his visiting Jordanian counterpart Nasser Judeh.

    “If there is genuine will for peace, it is time to openly display it,” he added.

    Judeh, for his part, said: “We agreed that unilateral moves in east Jerusalem will harm the peace process because such moves are not only confidence-shattering but also illegal.”

    Israel’s hawkish Prime Minister Benjamin Netanyahu on Tuesday agreed to curtail construction in the occupied West Bank that fell short of US demands for a settlement freeze.

    Critics, however, say construction continues on the ground in a number of settlements in Palestinian territory.

    TheMarker, a supplement to the Haaretz newspaper, reported Wednesday that Israeli authorities reversed a decision to reject bids for a 2008 project in east Jerusalem, paving the way for the construction of 450 housing units.

    Israel captured the territory in the 1967 Six Day War and subsequently annexed it in a move the international community has not recognized.

    Jordanian FM: Turkey’s role in Middle East peace important

    ANKARA, Aug. 19 (Xinhua) — Jordan’s Foreign Minister Nasser Judeh said on Wednesday that Jordan attaches great importance to Turkey’s role in the Middle East peace process, Turkey’s semi-official Anatolia news agency reported.

    Turkey should keep playing its role in the region, while Jordan highly values and is eager to boost its relations with Turkey, Judeh said at a press conference after meeting with his Turkish counterpart Ahmet Davutoglu during a visit to Ankara.

    Judeh said he would present a letter from King Abdullah II of Jordan to Turkish President Abdullah Gul on Wednesday, which underlined the importance of continuation of peace talks in the Middle East.

    He said there was currently a positive atmosphere in the region, while a solution to the Middle East issue would be possible with a comprehensive and fair peace as well as the establishment of an independent Palestinian state.

    He also noted that security and stability should be secured in Iraq, while restructuring works should continue.

    On his part, Davutoglu urged Palestinian factions to act for unity to achieve peace in the Middle East.

    “Our Palestinian brothers should come together with a common attitude and find a common ground of reconciliation in the shortest possible time,” Davutoglu said at the press conference.

    He said he hoped the upcoming Palestinian presidential and parliamentary elections in January would help maintain unity and create political stability in the territories.

    Judeh is on a visit to Turkey at the invitation of Davutoglu.

    The United States Government continues to support the delivery of urgently needed food, health, shelter and other emergency assistance to the people of Gaza through our ongoing support for international organizations such as the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), the World Food Program (WFP), and the International Committee of the Red Cross (ICRC) and non-governmental organizations (NGOs).
    On December 30, the United States announced a contribution to UNRWA for its 2009 appeals. Of the $85 million contribution, $5 million will directly support UNRWA’s Gaza Flash Appeal that will provide food, temporary shelter, and medical assistance for over 500,000 conflict-affected refugees in Gaza. The Flash Appeal funding will also supply up to 500,000 liters of fuel to municipalities and utilities for basic public services, including electricity and water treatment. $20 million will support UNRWA’s 2009 Emergency Appeal for the West Bank and Gaza, of which a large portion bolsters UNRWA’s ongoing emergency assistance activities for more than 1 million Palestinian refugees in Gaza. $60 million will support UNRWA’s General Fund for the provision of education, primary health care, and relief services to Palestinian refugees in the region, including Gaza.
    The United States Government continues to provide food assistance through the World Food Program (WFP) to 20,000 non-refugee Palestinian households in Gaza with a bi-monthly package of five basic foods. Since December 28, WFP and its implementing partner, Community Housing Foundation (CHF), have distributed some 720 metric tons (MT) of food commodities to beneficiaries in Gaza. An additional 1,350 MT is available in Gaza for distribution when the security situation allows.
    The United States Government also continues to support the International Committee of the Red Cross’s (ICRC ‘s) efforts to supply Gaza’s hospitals and clinics with urgently needed medicines, surgery kits, hygiene kits, intravenous fluids, bandages, plastic sheeting and other medical equipment. The ICRC is bringing two generators into Gaza to ensure continued operation of Gaza’s hospitals despite electricity cuts and maintenance problems resulting from a lack of spare parts.
    The United States Government has provided other medical and food supplies to health care facilities in Gaza, including syringes, tubes, gloves, x-ray film, tape, silk for sutures and bedding (mattresses, blankets and linens), and 18,000 kilograms of plastic sheeting to cover broken windows and help mitigate the cold.
    The United States is the largest bilateral donor to UNRWA, which provides essential services to hundreds of thousands of Palestinian refugees in Gaza, the West Bank, Lebanon and elsewhere.
    The United States is deeply concerned about the safety of civilians caught up in this conflict, and urges all sides to facilitate the provision of humanitarian relief.

    According to Turkish sources Hezbollah has said it will attack Israel from Southern Lebanon if ground troops are sent into the Gaza. Israel must be wary of this development given their experiences in the 2006 war against Hezbollah. If Hezbollah does get drawn into the fighting, this could well see Israel at the center of a broader regional conflict. There appears little doubt that Iran and Syria would support Hezbollah in any such offensive. Given the 10,000 plus Syrian troops poised on Lebanos’ Northern border, it seems unlikely that the fragile coalition Lebanese government could do much to inhibit Hezbollah’s offensive.

    Iran’s Press TV quotes the Lebanese paper al-Hayat as the the source of the report:

    “Turkey and Egypt are reportedly planning to warn Israel that any ground offensive in the Gaza Strip would trigger a response by Hezbollah.

    Citing Turkish sources, the Lebanese daily al-Hayat reported Tuesday that the two countries are seeking to warn Tel Aviv that Hezbollah might open a new front against Israel in Southern Lebanon, should Israeli army launch a ground incursion into the costal sliver.

    Tel Aviv has deployed thousands of troops along the Gaza Strip border on Tuesday, raising concerns over an imminent ground incursion into the region.

    The report came amid the ongoing aerial attacks which have so far left over 385 people killed and 1,800 others wounded in the Hamas-held territory. The military campaign against the region has been ongoing since early Saturday.

    According to the report, Egyptian Foreign Minister Ahmed Aboul Gheit held a meeting with his Turkish counterpart Ali Babacan on Monday to discuss a four-point plan for a truce between Israel and Hamas.

    The report added that the plan would include the removal of the Gaza blockade as well as guarantees for respecting the agreement.

    The daily claims that Turkey and Egypt believe that they could convince Israel to end its operation and avoid a ground offensive if they worked together.”

    ERETZ CHECKPOINT (Israel-Gaza border), January 2 (Itar-Tass) — The operation for the evacuation of Russian and CIS citizens from the Gaza Strip has come to a close. A total of 101 Russian citizens and 70 citizens of other CIS member countries crossed the border. Only several people remain at the Eretz checkpoint, who have some unsettled problems with the Israeli security services. Their settlement is going on. A truck column with the refugees will soon go to the Jordanian-Israeli border, and from there to Amman, where two planes of the Russian Emergencies Ministry (EMERCOM) are waiting for them.
