    Turkish Money Motivated Sen. Graham To Block Armenian Genocide Resolution 

    When Sen. Lindsey Graham (Republican-South Carolina) blocked the Senate vote on the Armenian Genocide Resolution on November 13, 2019, there was widespread speculation as to what motivated him to do so. The reasons ranged from his meeting with Turkish President Recep Tayyip Erdogan in the White House shortly before his vote, to his flip-flopping on several other issues, and to succumbing to Pres. Trump’s pro-Turkish policies.

    Another good reason to explain Sen. Graham’s vote against the Armenian Genocide Resolution is the money he had received from Turkish-Americans for his political campaigns.

    Ian J. Lynch wrote an article in the Ahwalnews.com website documenting the Turkish donations to Sen. Graham’s campaigns. These amounts are in addition to the millions of dollars that the Turkish government pays to American lobbying firms in Washington, D.C., to undermine the adoption of the Armenian Genocide Resolution in Congress. On October 11, 2019, Akin Gump Strauss Hauer & Feld, was added to the long list of American companies lobbying for Turkey. Interestingly, this lobbying firm was hired by TransAtlantic Petroleum, a Texas company with oil and gas interests in Turkey. Akin Gump is supposed to lobby to block the implementation of sanctions against Turkey, a bill that was overwhelmingly adopted by the House of Representatives on October 29, 2019.

    Lynch reported that the Armenian government spent no money on lobbying in the United States and the Armenian-American organizations in Washington, D.C. spent very little on lobbying compared to the millions of dollars spent by the Turkish government. “According to the most recent IRS returns, the AAA [Armenian Assembly of America] raised nearly $2 million in 2017, however, as a 501(c)(3) non-profit group it is not permitted to spend a substantial amount of its budget on lobbying. According to disclosures required by the Lobbying Disclosure Act (LDA), the AAA spent $95,000 on lobbying activities in 2018 and $80,000 so far in 2019. The ANCA [Armenian National Committee of America] is registered as a 501(c)(4) non-profit, meaning it can spend the majority of its budget on lobbying. Its total revenue in 2017 was nearly $850,000, but the organization only spent $120,000 on lobbying in each of the past two years, according to LDA disclosures.”

    After the US House of Representatives adopted the Armenian Genocide Resolution on October 29, 2019, the Turkish American National Steering Committee (TASC) went into action to stop the passage of the counterpart of the House bill in the Senate.

    According to Lynch, “TASC’s leadership and their associates have direct connections to Erdogan’s inner circle and a recent history of making individual political contributions to Graham…. TASC’s co-chairman, Dr. Halil Mutlu, is a cousin of Erdogan. He and his wife donated a total of $10,800 to Team Graham Inc., the senator’s re-election campaign for Senate in 2020, on Aug. 8, 2016. Their individual contributions of $5,400 each are the maximum an individual can give to a political campaign in the U.S. per election cycle. Mutlu’s employer, Baystate Medical Center in Massachusetts, is one of Team Graham’s biggest sources of donations. In the current election cycle, the hospital’s employees have contributed $21,600 to the senator’s 2020 campaign.”

    The employees of another Turkish-linked company, Nimeks Organics, are among the top donors to Sen. Graham’s campaign, providing a total of $16,200 in individual donations during this election cycle. “Nimeks is a product line of Natural Foods Group based in Pennsylvania, which imports food products from Turkey. The company’s CEO, Murat Guzel, is also the treasurer of TASC,” according to Lynch.

    In addition, the Guzel family donated a total of $8,100 to Graham’s presidential campaign on June 28, 2016, “despite the fact that Graham had dropped out of that race the previous December. The donation came shortly after the coup attempt in Turkey,” Lynch reported. “Just weeks later, Guzel and his family donated a further $10,800 to Team Graham, one day before the Mutlu family donated the same sum on Aug. 8. Neither the Mutlus nor Guzels are constituents of Graham, who represents South Carolina.”

    Strangely, Guzel was donating to a Republican Senator at a time when “he was the chair of the Democratic National Committee’s Heritage Council and contributed nearly $300,000 to democratic committees supporting Hilary Clinton’s presidential campaign,” according to Lynch. Guzel must have had a strong reason for heading one political party’s committee while donating to its opponent.

    Guzel maintained close contact with Berat Albayrak, Pres. Erdogan’s son-in-law and Treasury and Finance Minister, Bilal Erdogan, the president’s son, and Ibrahim Kalin, the President’s spokesman. From time to time, Guzel “asks Turkish officials for help coordinating his political activities,” which was made public after Albayrak’s emails were hacked, according to Lynch.

    It is not surprising that the FBI investigated TASC officials. “In a Sept. 8, 2016 email, Ibrahim Uyar, a co-founder of TASC, told Albayrak that the FBI questioned him about whether TASC and other Turkish organizations were involved in efforts to intervene in American politics on the Turkish government’s behalf. Uyar also indicated several others were questioned including Guzel and Halil Danısmaz, the founding president of the Turkish Heritage Organization (THO).” In emails to Albayrak years earlier, Danısmaz once proposed a “camouflaged” lobbying campaign to overcome “funding regulations and tax barriers that limit lobbying activities in the U.S.” When the emails were released, Danısmaz resigned from THO, Lynch reported.

    The Turkish Coalition Northeast PAC also contributed to Sen. Graham’s campaign. In April of this year, it gave its maximum allowable donation of $5,000 to Team Graham, “its largest gift to a candidate committee in the current election cycle,” Lynch revealed.

    After Sen. Graham made supportive remarks about Turkey at a conference in Munich, Team Graham received a $1,000 donation from the US lobbying firm Greenberg Traurig, LLP, which is hired by Turkey.

    Sen. Graham met with Greenberg Traurig lobbyists on January 10, 2019, a week before he visited Turkey to meet with Pres. Erdogan. While in Turkey, Erdogan invited Sen. Graham to attend a concert with him, which Graham described as “one of the best experiences” of his life.

    Lynch concluded his report by asserting: “What is clear is that the close-knit network of Turkish organizations and political action committees in the United States with ties to the Erdogan family think Graham is worthy of the investment of their time and political contributions.”

    We do not know the result of the 2016 FBI investigation of TASC and other Turkish American organizations, however, there seems to be sufficient ground to look into their possible violation of the Foreign Agent Registration Act, as unregistered lobbyists for a foreign government!

    Erdogan Meets Trump in the White House: The Result is a Tragicomedy

    It is difficult to know where to start commenting on the ridiculous press conference between Turkish President Recep Tayyip Erdogan and US Pres. Donald Trump at the White House on November 13, 2019. Unfortunately, we do not know what was discussed when the two presidents met earlier behind closed doors.

    Before Erdogan came to Washington, several Democratic and Republican members of Congress had signed a joint letter advising Pres. Trump not to invite the Turkish President to the White House which Trump ignored. This was not surprising given the fact that he had repeatedly called Erdogan “a friend” and “a tough guy who deserves respect.” Furthermore, Trump, as a presidential candidate in 2015, confessed that he had a financial interest in Turkey: “I have a little conflict of interest because I have a major, major building in Istanbul. It’s called Trump Towers — two towers, instead of one. … And I’ve gotten to know Turkey very well. They’re amazing people. They’re incredible people. They have a strong leader.” During the joint press conference, Pres. Trump described Turkey as “a great NATO ally,” “a strategic partner of the United States,” and “I am a big fan of the President [Erdogan].”

    Trump refused to impose legally required sanctions on Turkey for the purchase of Russian S-400 missiles. NBC News reported last week that former National Security Adviser John Bolton stated during a speech in Miami “that he believes there is a personal or business relationship dictating Trump’s position on Turkey because none of his advisers are aligned with him on the issue.” The House of Representatives had adopted two resolutions a week earlier reaffirming the recognition of the Armenian Genocide by the overwhelming bipartisan vote of 405 to 11, and placing sanctions on Turkey and some of its leaders, including Erdogan, by a vote of 403 to 16, after Pres. Trump withdrew US forces from Northern Syria, abandoning the Kurdish partners and allowing the Turkish military and its jihadist allies to murder hundreds of Kurdish civilians and deport around 200,000 Kurds and others from the area South of the Turkish border.

    At the White House press conference, there were several astonishing moments. First of all, Erdogan expressed his anger at the Armenian Genocide Resolution adopted by the House of Representatives on October 29, 2019. Erdogan repeated the usual Turkish propaganda line that there should be a historical commission to study the facts of the Armenian Genocide, while Pres. Trump silently looked on. Neither Erdogan nor Trump is probably aware that this issue has been studied by scores of historians, including the International Association of Genocide Scholars, which issued a joint statement confirming the veracity of the Armenian Genocide.

    During the joint press conference, Pres. Trump encouraged Erdogan to call on a Turkish journalist for a question. Trump told Erdogan: “Would you like to pick somebody? A friendly person from Turkey, friendly. Only friendly reporters. We like to see, there aren’t too many of them around.” There are no journalists left in Turkey who are not friendly to Erdogan. This year alone, 68 journalists were arrested in Turkey which has jailed more reporters than any other country in the world.

    Trump then proceeded to whitewash Erdogan’s crimes against Kurds by stating: “And, by the way, I think the president [Erdogan], he may have some factions within Kurds, but I think the president has a great relationship with the Kurds. Many Kurds live currently in Turkey, and they’re taken care of.” This is an absolute lie! Over 30,000 Kurdish citizens of Turkey have been killed by the Turkish military in the last few decades. Furthermore, 15 elected Kurdish mayors were dismissed by the Turkish government and arrested on trumped up charges.

    During the White House press conference Erdogan made another scandalous statement saying that he returned a letter that Pres. Trump had sent him on Oct. 9, 2019, by leaving it on the President’s desk during their meeting. In that letter, Pres. Trump had told Erdogan, “Don’t be a tough guy! Don’t be a fool!”

    Erdogan made one more idiotic comment on November 13, 2019, during his visit to the Washington Center of Turkey’s Directorate of Religious Affairs. Erdogan claimed that Armenians were “nomads” during the Armenian Genocide. Armenians “used to travel in different places as nomads. The forced deportation took place while they were living the same way as nomads in Turkey,” Erdogan falsely alleged, ignoring that Armenians were natives in their lands where they had lived for thousands of years before the Turkic tribes came from East Asia and conquered their homeland.

    An incredible conversation took place a week before Erdogan arrived in the United States. Turkish newspaper Sabah reported that during a phone call between the Turkish and US presidents on November 5, 2019, Erdogan said Pres. Trump asked him “whether it would be more suitable to use the word ‘war’ instead of calling it ‘genocide’?” Surprisingly, Erdogan said he rejected Trump’s suggestion on the grounds that “a war is between two states and that Armenians had in fact been subject to forced migration.”

    Erdogan told Trump that “there are efforts to intimidate us with the so-called Armenian bill and sanctions threat.” Pres. Trump then asked Erdogan how previous US presidents handled the Armenian Genocide issue, to which Erdogan replied: “Until now, I have worked with Bush and his son, and in the same way with Obama. Now I am working with you. At that time, they would refer this [genocide resolution] to the [House] committee and the committee would send it back. This time they bypassed the committee and sent it to the Congress.” Erdogan said Trump replied: “I will study it and talk to friends.”

    Of course, Erdogan gave false information to Pres. Trump. The Armenian Genocide resolution had been approved by the full House of Representatives twice before in 1975 and 1984, and had passed through the House Foreign Affairs Committee several times.

    It is ironic that Pres. Trump is asking Erdogan for advice on what to call the Armenian Genocide and how previous US presidents handled the genocide issue. All those ‘proud’ Armenian-American supporters of Trump should initiate immediate steps to educate the US president on the facts of the Armenian Genocide so he is not fed lies by the likes of denialist Erdogan!

    Immediately after his meeting with Erdogan and the joint press conference on Nov. 13, Pres. Trump invited a small group of Republican Senators to the White House to meet with Erdogan at Trump’s presence. This was an obvious ploy on the President’s part to dump the responsibility on the Senate for any action the Senators may take against Turkey.

    Following this meeting, when the Senators returned to the Senate floor, Sen. Robert Menendez (Dem.-N.J.) proposed to suspend the rules and bring the pending Armenian Genocide resolution directly to the full Senate bypassing the Senate Foreign Relations Committee. Sen. Lindsey Graham (Rep.-South Carolina) objected to Sen. Menendez’s request for consent. Under Senate rules, all it takes is one Senator to object, to prevent the Resolution to bypass the Senate Foreign Relations Committee. Sen. Graham, in his Senate remarks, explained: “I just met with President Erdogan and President Trump about the problems we face in Syria by the military incursion by Turkey. I do hope that Turkey and Armenia can come together and deal with this problem.” Sen. Graham added that he was objecting “not because of the past but because of the future.” Those remarks made his objection even worse.

    Sen. Graham’s rejection has confused some people into believing that the Armenian Genocide resolution is dead in the Senate. It is not. The Senate Foreign Relations Committee now has to consider the resolution and then, after approval, forward it to the full Senate.

    Armenians Fly from Istanbul to New York To Participate in Turkish Propaganda

    It is amazing the lengths to which the Turkish government went to include Istanbul Armenian clergy and laymen in its propaganda campaign.

    On November 5, 2019, Turkish President Recep Tayyip Erdogan’s Communications Office organized an exhibit in New York City featuring photos of the Armenian Holy Cross Cathedral located in Western Armenia, today’s eastern Turkey, near Van, on Aghtamar Island.

    The opening of the exhibit was not only attended by Alper Aktas, Turkey’s Consul General in New York, but surprisingly, by several Armenian leaders as well as other Christian clergymen from Istanbul. Among the attendees were Istanbul Armenian Patriarchate’s Locum Tenens Bishop Sahak Mashalian; Shirvan Murzoyan, an Armenian priest from Istanbul; Yessayi Demir, Chairman of St. Kevork Church in Samatia, Istanbul; Mesut Ozdemir, Chairman of Dsnount Sourp Asdvadsadsni Church; Yetvart Ayvazian, Chairman of Sourp Krikor Lousavorich Church in Kouzgounjouk, Istanbul; Tamar Karasou, Director of the Turkish Branch of Sourp Krots Association; Aram Kouran from “Louys” biweekly; Chairman of the Board of Sourp Prgich Armenian Hospital in Istanbul, Bedros Shirinoglu and his wife; Turkish Minority Community Foundation Representative Moris Levi; Syriac Ancient Church Foundation President Sait Susin; American Greek Orthodox Church Archbishop Elpidophoros Lambriniadis; and members of the Turkish and Armenian communities. I am pleased that none of the clergy from the Armenian Church in the United States (Prelacy and Diocese) attended the opening of the exhibit in New York.

    While it is understandable that given the tense relations between the United States and Turkey, the Turkish government would want to carry out a propaganda campaign in the US to improve its stained image, much less acceptable is the participation of the Armenian laymen and clergy as well as Syriac and Greek leaders. One can excuse the attendance of the Istanbul leaders given the fact that they are hostages in the hands of the oppressive Turkish regime. In the case of Bishop Mashalian, however, he may have come willingly, as he is one of the two candidates for the December election for the position of the Armenian Patriarch of Turkey. The Bishop knows well that any disobedience to the wishes of the Turkish government will cost him the seat of the Patriarchate.

    Despite the strong desire of Erdogan’s government to carry out propaganda in the US, it failed to capitalize on this opportunity. Turkey spent a fortune to fly the 88 photographs of the Holy Cross Church to New York, pay for the rental of an exhibit hall in Manhattan, fly and accommodate over a dozen guests from Istanbul to New York City, and pay the expenses of making a film on the Holy Cross Cathedral, “The Hidden Monuments of Anatolia Coming to Light: Akdamar,” shown at the exhibit. Yet, the highly-paid US lobbying firms hired by Turkey either were not asked or failed to disseminate the exhibit propaganda to the American media. Secondly, the Turkish government did not think of delaying the opening of the exhibit by one week so Pres. Erdogan, who will be in the US this week, could attend the official ribbon cutting ceremony. In September, Pres. Erdogan was present in New York at a similar opening of the exhibit of the photos of Ara Guler, a Turkish Armenian, which was also sponsored by the Turkish President’s Office.

    Here are the reasons why I consider the Holy Cross Church photo exhibit a manifestation of Turkish propaganda:

    1)  The Turkish government has designated Holy Cross as a museum, not a church, allowing Armenian liturgy to be performed only once a year by special permission. Much more important than organizing an exhibition in New York would have been the designation of the Holy Cross edifice as a church, not a museum. What are the Armenian and other clergymen doing celebrating the exhibit of a museum? If they had any guts, they would have refused to attend the exhibit until the museum is designated as a church which was completed in 921 AD, under the sponsorship of Armenian King Gagik Ardsruni. Visitors have even to pay a fee to enter “the museum.”

    2)  After the Holy Cross Cathedral was repaired in 2007, the Turkish government did not allow a cross to be placed on the dome of the church, giving the excuse that the cross was too heavy for the dome. Finally, after much criticism, in 2010 the Turkish government allowed a cross to be placed atop the Holy Cross Cathedral.

    3)  The Turkish government turkified the name of the island by changing it from Aghtamar to Akdamar (which means “White vein” in Turkish).

    4)  In his remarks, Bishop Mashalian praised Pres. Erdogan for organizing the exhibit in New York: “Under the leadership of the president’s vision, special attention and interest was shown in the Akdamar Church…. This is a cultural initiative to overcome the difficulties of communication between the Turkish and Armenian peoples, as well as a bridge to a better future and understanding based on goodwill.”

    5)  Chairman of the Board of Sourp Prgich Armenian Hospital in Istanbul Bedros Shirinoglu stated that “President Recep Tayyip Erdoğan has made great efforts for minority communities…. We would like to express our gratitude to him for all his help and to the {President’s] Communications Office for this exhibition.

    6)  American Greek Orthodox Church Archbishop Elpidophoros Lambriniadis reinforced the Turkish propaganda by underlining the significance of the photos at the exhibition in terms of showing the importance attached to the Christian minority in Turkey, saying: “Turkey is going in the right direction and it is good to tell the whole world about this.”

    7)  Pres. Erdogan proudly told the Turkish media last week that 17 representatives of Turkish minority groups are in New York at this time for the photo exhibit of the “Akdamar Church.”

    If the Turkish government was truly sincere in promoting the Armenian Church in Aghtamar, why did it allow a group of Azeris recently to visit the church and claim it to be a Caucasian Albanian Christian church? This is the usual lie that the Azeri government uses to describe all historic Armenian churches in Azerbaijan. The Azeri visitors displayed inside the Holy Cross Church the Azeri and Turkish flags with an “Azeri priest” claiming to say prayers. In a statement made outside the front door of the church, an Azeri representative accused Armenians of invading Azerbaijan and committing vandalism. The Turkish government should apologize to Armenians for allowing the perpetration of such a gross lie!

    Trump Surrenders to Erdogan’s Demands: The Tail Wags the Dog

    Anytime Pres. Trump talks to another head of state on the phone, we can expect a disastrous outcome. Trump does not realize the consequences of his decisions on the United States and the world. He does not ask for proper briefing from his top aides and does not follow their advice.

    Pres. Trump’s telephone conversation with Turkish President Recep Tayyip Erdogan on October 6 was no exception. While the White House reluctantly released the summary of Pres. Trump’s scandalous phone call with the President of Ukraine followed by the whistleblower’s report, Trump’s conversation with Erdogan is not yet made public and no one knows what exactly transpired during that phone call. All we know is that Erdogan asked Trump to remove the U.S. troops from Northern Syria, allowing Turkey to invade Syria, to expel hundreds of thousands of Kurdish civilians from the 20-mile area inside the Syrian border, and kill hundreds of Kurds, the US allies on the ground in the fight against ISIS terrorists. The Turkish troops are committing War Crimes and Pres. Trump has allowed them to do so!

    The whole world immediately realized that this was a grave mistake by Trump. Even Republican members of Congress who had been blindly supporting him and ignoring his many illegalities and immoralities, have loudly criticized their ‘darling’ President. The US Congress discussed adopting sanctions against Turkey which pressured Trump to do the same.

    On Oct. 9, three days after Erdogan’s phone call with Trump, the Turkish forces invaded Syria. On that same day, Trump sent Erdogan a childish letter, threatening to “destroy the Turkish economy — and I will.” Trump also warned Erdogan that history “will look upon you forever as the devil if good things don’t happen.” Trump ended his letter by telling Erdogan “don’t be a tough guy. Don’t be a fool! I will call you later.” This was a uniquely stupid presidential letter in the annals of diplomatic correspondence. Pres. Erdogan’s office stated that he promptly dumped Trump’s letter in the garbage can, where it belonged!

    In the meantime, in response to strong criticism by almost everyone in the world — except for Turkey, Azerbaijan and Russia — Pres. Trump started spewing his usual nonsense. First, he called the Kurds US allies. He then changed his mind and called them “Communists,” “terrorists” and “no angels.” Trump went so far as blaming the Kurds for not supporting the US army in Normandy, France, during the Second World War, forgetting that the Kurds possessed neither a country nor an army! According to the Washington Post, Pres. Trump has made 13,435 false and misleading claims in his first 1,000 days in office. That’s on average 13 lies per day — an unprecedented record for anyone, let alone the President of the United States!

    After undermining the Kurds in his pronouncements, Pres. Trump dispatched his Vice President Mike Pence and Secretary of State Mike Pompeo to Ankara, supposedly to restrain Erdogan’s brutal treatment of Kurds in Northern Syria.

    After several hours of negotiations, the two sides made contradictory announcements about what they had agreed upon. The American side called the agreement a “ceasefire,” while the Turkish side called it a “pause” for five days. Nevertheless, Trump quickly claimed to have scored a major victory, as he does on all occasions, usually without any merit. If anything, it was a victory for the Turks who gained everything they wanted from the United States — the green light to proceed with their invasion of Northern Syria, mass deportations and brutal killings of Kurds. What’s worse is the escape of hundreds of ISIS terrorists from their detention camps during the Turkish attack. The ceasefire or the pause did not even last 24 hours! The Turkish forces and their jihadist partners violated it on day one. Only a fool would trust Erdogan’s promises or agreements. Amazingly, Trump agreed to remove the US sanctions against Turkey before they were even implemented.

    The removal of the US sanctions was confirmed in a lengthy letter signed by the Turkish and US delegates at the UN, titled “Joint Turkish – US Statement on Northeast Syria” which was submitted to the UN Security Council and the UN Secretary-General on October 17.

    In this letter, the US shamelessly capitulated to all of Turkey’s demands:

    — “…The US understands Turkey’s legitimate security concerns on Turkey’s southern border.”

    — “The Turkish side expressed its commitment to ensure safety and well-being of residents of all population centers in the safe zone controlled by the Turkish Forces and reiterated that maximum care will be exercised in order not to cause harm to civilians and civilian infrastructures.”

    — “The two sides agreed on the continued importance and functionality of a safe zone in order to address the national security concerns of Turkey, to include the recollection of YPG heavy weapons and the disablement of their fortifications and all other fighting positions.”

    — “The Turkish side will pause Operation Peace Spring in order to allow the withdrawal of YPG from the safe zone within 120 hours. Operation Peace Spring will be halted upon completion of this withdrawal.”

    — “Once Operation Peace Spring is paused, the US agrees not to pursue further imposition of sanctions under the Executive Order of October 14, 2019, ‘Blocking Property and Suspending Entry of Certain Persons Contributing to the Situation in Syria,’ and will work and consult with Congress, as appropriate, to underline the progress being undertaken to achieve peace and security in Syria, in accordance with UNSCR 2254. Once Operation Peace Spring is halted as per paragraph 11 the current sanctions under the aforementioned Executive Order shall be lifted.”

    Interestingly, the text of the US – Turkish agreement never once mentions the Kurds by name, whereas the whole Turkish invasion is being carried out for the purpose of eliminating Kurds from Northern Syria.

    The United States forces were stationed in Syria in violation of international law, and contrary to the wishes of the Syrian government. The same applies to the Turkish forces. The departure of the US forces is not wrong. Their arrival was wrong. And Trump’s claim that he wants the US forces out of the Middle East is an outrageous lie, since the same day that he decided to withdraw the American troops from Syria, it was announced that most of these soldiers would be relocated to Iraq and he will send 3,000 fresh US troops to Saudi Arabia. This is yet another one of Trump’s lies which needs to be added to his over 13,000 other lies!

    A 48-page Central Intelligence Agency Top Secret Report, prepared in August 1988 and made public in 2012 with some deletions, is titled “Unrest in the Caucasus and the Challenge of Nationalism.” Despite the passage of time, the Report includes an interesting analysis of the Artsakh (Nagorno-Karabakh) conflict from the perspective of U.S. intelligence services.

    The CIA analyst, in the introduction of his Report, traced the origins of the Artsakh conflict: “Enmity between Armenian and Azeri factions has existed for hundreds of years, and the 1920s settlement subordinating Nagorno-Karabakh — Armenia’s cultural and religious center — to the Azerbaijan Republic has been a continual, albeit long-muted, source of Armenian frustration and concern. Azeri animosity toward the Armenians has been intensified by political, economic, and demographic trends that have adversely affected the political status of Azeris and increased the gap in living standards between Azerbaijan and Armenia. In particular, the rapid expansion of Azerbaijan’s young adult population has put enormous strain on the Republic’s capacity to provide adequate jobs, housing, and education. Azeri frustration has found an outlet in attacks on Armenians.”

    The unnamed CIA analyst reported that a split within the Politburo on how to handle the Artsakh crisis made the situation worse. Second Secretary Ligachev and KGB Chief Chebrikov were the hardliners who vehemently opposed the separation of Artsakh from Azerbaijan. They disagreed with Gorbachev’s reforms and blamed foreign powers for inciting unrest inside the Soviet Union.

    When two prominent Armenian writers, Silva Kaputikyan and Zori Balayan, met with Gorbachev in Moscow in February 1988, they reported that he was well briefed and assured them that he wanted a “just solution.” He acknowledged “the peaceful nature of the [Armenian] demonstrations and emphasized his personal sympathy with the desire to reunite Nagorno-Karabakh with Armenia….”

    Upon the return of the Armenian envoys to Yerevan, in a radio broadcast on February 27, 1988, Kaputikyan called for Armenians to trust Gorbachev. “He knows about and understands our problem and wants to resolve it personally…. We must do our utmost to ensure that no harm” is done to him, Kaputikyan announced.

    Regarding Soviet concerns about foreign, particularly Armenian-American interference in domestic Soviet turmoil, the CIA analyst reported: “The recent unrest appears to have made Soviet officials more fearful about the role of foreign actors in the Nagorno-Karabakh problem. Of the approximately 5.5 million people in the world today who speak Armenian, about 60% live outside the Soviet Armenian republic, about 1.4 million elsewhere in the USSR, and 2 million abroad. So far, Armenian emigres — most of whom see Turkey much more than Russia as the historic oppressor of their nation — have not been actively involved in pushing for change in the Soviet system or in Soviet policies. Moscow worries that diaspora attitudes could turn sharply critical of the USSR and that Armenians in the United States, particularly, could grow into a powerful anti-Soviet pressure group. Soviet officials are wary of the large concentration of Armenians in California and New York, states with large electoral votes that have been closely contested in previous presidential elections.”

    In a footnote at the end of the previous paragraph, the CIA analyst specified that “the United States hosts at least 600,000 Armenians. About 90 percent of America’s Soviet Armenian immigrants came to California. Los Angeles — with 100,000 — has the largest community of Armenians outside Yerevan. The New York City region has about 70,000 Armenians, mostly from Lebanon and Iran.”

    The CIA analyst added: “Moscow may be concerned that foreign Armenian terrorist groups like the Armenian Secret Army for the Liberation of Armenia (ASALA) could turn against Soviet targets — although we have no evidence that this is the case. Hitherto, the USSR has figured very little in ASALA’s blending of armed struggle with Marxist ideology; the dominant faction of ASALA considers Soviet Armenia as liberated territory and the group concentrates its attacks exclusively on Turkish officials. In fact, ASALA eventually would like to see ‘the Armenian provinces’ now located in Turkey and possibly Iraq [?] reattach themselves to the Soviet Armenian core. Furthermore, ASALA is now in a quiet phase, and its leader was assassinated on 28 April [1988]. Nevertheless, ASALA in early April did send a moderately worded appeal to Gorbachev supporting the reunification of Karabakh with Armenia, while characteristically stressing that Armenia is an integral part of the USSR and seeks only to rectify the border, not to pursue claims against Moscow.”

    Finally, the CIA analyst explained the position of Turkey on the Karabakh conflict: “Although the Turkish Government has not explicitly sided with Azerbaijan, Turkey’s fear of resurgent Armenian nationalism makes Ankara sympathetic to Baku. When the crisis broke in February [1988], Turkish Government spokesmen indicated publicly that international agreements entitle Ankara to a voice in the crisis, an apparent reference to the 1921 treaty between the USSR and Turkey that led to the shift of Nagorno-Karabakh and Nakhichevan to Azerbaijan. Turkey no doubt especially feared that transferring Nagorno-Karabakh to Armenia would whet Armenian appetites and would lead to increased pressure to change the status of Nakhichevan and to acquire former Armenian regions in Turkey. Turkish officials probably also noted that some Armenian expansionist demands for a ‘Greater Armenia’ were based on historic claims rather than on the ethnic composition of the affected territories. Thus, some Armenians have demanded the return of Nakhichevan, even though Azeris now greatly outnumber Armenians in this region. Using such historical criteria, could give Armenians a claim even on some border parts of Turkey where only 50,000 Armenians now live.”

    The CIA analyst concluded his Report by outlining five options the USSR had for the resolution of the Artsakh conflict:

    1)  “Sticking with the Status Quo”

    2)  “Making Further Economic Concessions” to Armenians

    3)  “Enhancing Autonomy of Nagorno-Karabakh Within Azerbaijan”

    4)  Expanding “Extraterritorial Native Cultural Institutions”

    5)  “Reconfiguration of Nagorno-Karabakh” by splitting it between Armenia and Azerbaijan.

    Jerusalem Armenian Patriarchate’s Lawsuit Advances Through Turkish Courts

    While the lawsuit filed by the Catholicosate of Cilicia based in Antelias, Lebanon, for the recovery of its former headquarters in Sis, Turkey, has received wide publicity, another just as important lawsuit against Turkey, is hardly known by the Armenian and international community.

    This relatively unknown lawsuit was filed by the Armenian Patriarchate of Jerusalem seven years ago. During the last few years, the only news published by an Armenian newspaper in Istanbul has been about the various visits of Jerusalem Patriarch Nourhan Manougian to Turkey regarding claims filed for the Patriarchate’s properties in that country. There have been no announcements by the Jerusalem Patriarchate and no interviews published in any Armenian media on this important lawsuit.

    The first major news was published by the Turkish newspaper Hurriyet on October 2, 2019 regarding the Jerusalem Patriarchate’s lawsuit in Turkey. Hurriyet reported that the Constitutional Court (the highest court in Turkey) ruled on September 12, 2019 that the lower Turkish court had violated the rights of the Armenian Patriarchate by denying proper access to the court to pursue its lawsuit (Article 36 of the Constitution). The Constitutional Court stated that the lower court had not sufficiently investigated the claims of the Armenian lawsuit.

    The Armenian Apostolic See of St. James in Jerusalem had filed a lawsuit in an Ankara court on August 26, 2016, seeking the recovery of its properties in Turkey. The Turkish documents refer to the St. James Congregation of the Jerusalem Patriarchate as Mar Yakoub which is the Turkish translation of Saint James or Sourp Hagop. The two different names had caused confusion in the court as to the true identity of the ownership of these properties.

    The Constitutional Court sent the lawsuit back to the Ankara court demanding that the lower court review the matter by conducting further investigations. If the lower court reconsiders its earlier rejection, it would open the door for the pursuit of the lawsuit through the Turkish court system.

    I had the honor of speaking by telephone with Patriarch Nourhan Manougian last week regarding the status of the lawsuit. To my knowledge, this was the first interview that his Eminence has granted to a member of the media on this subject. He informed me that the Armenian Patriarchate in Jerusalem owned around 1,200 properties in Istanbul alone. The Patriarchate also owned dozens of other properties throughout Turkey which were confiscated by the government during the period of the Armenian Genocide in 1915. Patriarch Manougian mentioned that a very large and valuable property owned by the Jerusalem Patriarchate in Yalova, Turkey, was sold by a Turkish-Armenian in the 1950’s to a Turk and then fled to the United States. The Patriarch said he is interested in filing a lawsuit against the heirs of that Turkish-Armenian.

    On August 7, 1973 the Turkish General Directorate of Foundations initially included the Jerusalem properties on its list. When the decision was made to exclude these properties from the General Directorate of Foundations, the Jerusalem Patriarchate filed a lawsuit on July, 19, 2012. However, the Turkish court dismissed the lawsuit. Even though the Patriarchate won the appeal, the court rejected the decision!

    The Constitutional Court stated that at this point there was no need to examine the right of ownership of the properties claimed by the Armenian Patriarchate of Jerusalem.

    The Constitutional Court further ruled that “before the documents and records, particularly the administrative examinations of the legal matter are presented to the court, it should have been possible to clarify if there was a second Foundation or not. Without clarifying all these issues and without realizing all these necessary examinations, the rejection of the lawsuit has caused a great inconvenience to the applicant [the Patriarchate], and the interference in its right to apply to the court has been disproportionate. With this rejection, the 36th Article of the Constitutional Court is violated — defending one’s rights through trial.”

    This is a critical lawsuit not only for the Armenian Patriarchate of Jerusalem but also for the entire Armenian nation. The sheer number of the 1,200 properties demanded by the lawsuit makes it highly valuable, particularly given their location in Istanbul, the most prominent Turkish city.

    While it is too early to speculate about the final outcome of this lawsuit, it is probable that should the Patriarchate regain the possession of some, if not all, of the 1,200 properties, the Turkish government may not allow the sale of these properties and the taking of the income out of Turkey, permitting only the use of the properties or their lease to others. The generated income could then be used to support the Armenian schools and churches in Turkey.

    However, should the lower court and the Constitutional Court rule against the Armenian Patriarchate, it can then file a lawsuit in the European Court of Human Rights.

    The Catholicosate of Cilicia is in the process of following the same scheme, after its lawsuit with the European Court of Human Rights was rejected because it had gone directly to the Constitutional Court of Turkey, sidestepping the lower Turkish court. The Catholicosate is now refiling its lawsuit with the lower court in Turkey.

    The decision of the Turkish courts on these two lawsuits, followed by the European Court of Human Rights, if necessary, will reshape the agenda of the legal pursuit of the Armenian demands from Turkey, beyond its simple recognition of the Armenian Genocide.
