TURKEY: Celebrity lawyer takes on Turkish government, banks for Armenian assets

The Los Angeles-based Lawyer Mark Geragos is used to representing celebrities like Chris Brown and the late Michael Jackson, but he recently took on a very different kind of case, one with deep personal significance for him.

Last Thursday, Geragos and his team of litigators filed a lawsuit against Turkey and two major Turkish banks seeking restitution for Armenian properties and assets that were seized by Ottoman forces during the mass killings that took place almost a century ago and that many have labeled the first modern genocide.

Turkey denies the killings constitute genocide, and the United States’ federal government has not formally recognized them as such, although 44 states have done so individually. Earlier this year, the U.S. House of Representatives Foreign Affairs Committee approved a measure to officially recognize the killing of Armenians as genocide, but it has yet to make it to the floor for a vote.

Geragos spoke with Babylon and Beyond in a recent interview about the significance of the case and his personal connection to it:

B&B: You have been involved in some very high-profile criminal cases. How is this lawsuit different for you and the other lawyers involved? It is our understanding that they are all of Armenian descent.

Geragos: We have all had serious cases, but all of us had relatives that were victims… it’s extremely moving and infuses great passion in your work. It’s one of those where you find out what it really means to be a lawyer.

B&B: So after almost a century since these crimes were committed, what are the circumstances causing these charges to be filed now?

Geragos: What I can tell you is that the emergence of certain documents and facts are behind the filing of this lawsuit. Unfortunately, for strategic reasons I can’t tell you much more…. You should see some development in 180 days.

B&B: Can you comment on the estimates for the amount to be paid to the descendants of the victims?

Geragos: We haven’t even begun to fathom the amount to be compensated but the amount paid to the plaintiffs and those with deeds will clearly be in the billions.

B&B: Is there any legal precedent for a case like this? Are these cases similar to any from the Jewish Holocaust?

Geragos: Other than a lawsuit involving Hungary and stolen artwork this is the closest thing to that, but this is obviously more all-encompassing in scope given what was taken. The Holocaust cases for the most part were settled between countries. The Armenian cases have been exclusively litigated in the courtroom.

B&B: What is the significance of a case like this in terms of gaining more international recognition for crimes that were committed against Armenians?

Geragos: Really we are beyond recognition. Reagan called it “Genocide”…The “R” word is really restitution, not recognition. Restitution is now considered a right when you are a victim of a crime and this is really where we need to fight it. Restitution for Armenians is also an integral part of rebuilding now that Armenia has its independence.

B&B: What are your hopes for this case and what it will represent?

Geragos: One would hope that this could serve as a flashpoint for the Turkish people themselves to realize that history is moving forward and they should be trying to make restitution instead of putting their heads in the sand. They should embrace it and move past it instead of spending money on lobbying to deny a historical fact…. We have yet to see any major reactions to the filing of the suit in Turkey; however there has been tremendous support from the international community.

    Hey Mark G. and all of you other dashnak Armenians:

    Do you really think that Turkey will sit still and do nothing? Turn around is fair play! Be ready for hundreds, if not thousands, of retalitory lawsuits to soon be filed in every court on the planet, against Armenia and ALL of the deep-pocketed Armenian organizations here in the US and Europe (ARF, AYF, ANCA, etc.). Armenia would go belly-up quite quickly, while all of the Armo organizations declare bankruptcy. Then the real fun begins when we do a massive class action suit against Mark. G., his firm, and every single Armenian who was part of the original lawsuits.

    One thing that you Armos seem to keep forgetting is that every court, judge and jury is going to DEMAND to see the one thing which none of you posses…UNALTERED EVIDENCE!!! Once we show all of the forged documents, fabricated and altered photos passed off as being authentic, etc by producing the authentic ones, let’s see how much credibility you “people” will then have! No court will even bother to hear your suits and most, if not all, will simply throw them out! But, it won’t end there. That’s when all Turkish AND Turkic peoples will file continuous lawsuits and counter-suits! I can just see Mr. Geragos standing by a road, holding a sign saying…”Will do anything nefarious for money and/or food”!

    Careful what you wish for! That genie is hard as hell to get back into the bottle.

    Please file your mega super giant class action asap. Maybe Sam Weems will draft it for you. Is he still dead, or merely poisoned by Arkansas Armenian witch doctors?

    I do recommend that you sue Mark and assert that you are suing him to retaliate because of another lawsuit he filed. After all, that’s the Turkish Way [“what First Amendment? – we’re Turks!”].

    By the way, Turkish groups tried to bring a case like that before, and ended up eating their legal fees while being laughed out of Court. But, who knows? With you at the helm, I’m sure you’ll do nicely – for Christian Anatolian lawyers.

    Armenians know they cannot win. They do it anyway to artificially boost an aura of victimhood and credibility, totally disregarding Armenian revolts, treason, and war crimes.

    Even if we forget for a moment that this claim will probably be thrown out due to jurisdiction issues (a citizen cannot sue a foreign government based on personal feelings of hate and vengeance) or time lapse (95 years) or lack of authenticity, credibility, and justification, the following international agreements make the bogus Armenian claims stillborn: Kars (1921) and Lausanne (1923).

    But there is yet another international agreement that puts the last nail on the coffin of the greedy Armenian crooks: bilateral agreement inked on April 25, 1935 between Turkey and the United States which says:

    ” … the two governments agree that, by the payment of the aforesaid sum, the Government of the Republic of Turkey will be released from liability with respect to all of the above mentioned claims formulated against it and further agree that every claim embraced by the agreement of December 24th 1923, shall be considered and treated as finally settled”.

    Questions, anyone?

    Man, your audience must be getting les as your routine becomes old! Better hang on to those dimes. Your representation of the Armo lawyers was at best, passable! Really, I expected better than that!

    One word of advice…fun is fun as long as it’s kept civil, okay! Even though the rest of the planet doesn’t take you seriously (after all, you are a clown!), to defame Mr. E.K. or someone living is one thing (they can at least defend themselves). But to defame and ridicule a decent man who is dead and can’t defend himself is just plain low…even for an Armo clown! Then you wonder why you people are not, well to say it in plain language, very well liked globally!
